EFFICIENCY AND JUSTICE IN EUROPEAN CONTRACT LAW

2008

Abstract: In the last century, refl ections on contract law have been almost entirely dominated by classical contract theory and laissez–faire ideology, while open considerations of effi ciency and justice have played a marginal role. The rise of European contract law has gradually led to the abandonment of traditional arguments typical of national private laws and has sparked a growing debate on effi ciency and justice. This trend does not always contribute to the quality of the debate, as it is often ideologically polarized between ‘right wing’ arguments pleading in favour of marketoriented polices and ‘left wing’ arguments in support of consumers’ rights, both proposing solutions inspir…

Facebook

2021

In this intervention the idea is submitted that the interim measures in the case Casapound v. Facebook, by means of which Fb Ireland was ordered by the Rome Tribunal (on December 12, 2019) to reactivate the profile of the extreme right wing political association Casapound - previously closed as a consequence of an alleged violation of fb standards concerning hate speech - can be criticized under international and european law. Such criticisms stem both from the overall picture of the international and european legal standards concerning hate speech (par. 2) and from the relevant case law of the European Court of Human rights (paras. 3 and 4).

The COVID-19 Crisis, Human Rights and Unfair Models of Production: The Case of Migrant Workers in the Agri-food Sector in European Countries

2022

Since its outbreak, the COVID-19 crisis has sharply exacerbated the structural inequalities that characterize the socioeconomic systems of European Union (EU) countries, disproportionately impacting people most affected by discrimination and social exclusion. The Covid-19 crisis has also brought under the spotlight the significant role of migrant workers in core sectors – such as the agri-food sector – disclosing how they are fundamental in the economic and societal functioning of EU countries. At the same time, the pandemic has sharply disclosed the limits of long supply chains (in terms of price distortion, unfair competition and distribution dynamics), as well as the conditions of exploi…

Smoke gets in euro-eyes: fusione e fissione del diritto comunitario

2021

This essay reconstructs the mechanism of the mutual “influence” between European Union Law and the Law of member states. In particular, the mechanism of the disapplication of domestic law has been assumed on the light of the comparison with the common law system and the relationship between equity and case law. Thanks to this comparative approach and the analysis of the jurisprudence of the Supreme Court (formerly House of Lords), the Author highlight the nature of “delegation” of powers and not of transfer of sovereignty inherent in the relations between member states and the European Union. At the same time, through the reconstruction of the jurispru- dence of the European Court of Justic…

Droghe leggere e criminalità organizzata: una relazione problematica

2022

With judgement n. 2315/2020 the Supreme Court affirmed the principle that the ascertaining of seniority of service of the employee because of a transfer of undertaking can be examined by the judge according to the special rules of law n. 92/2012. The Court does not exclude a transfer of undertaking also in the case it concerns the staff only for a contractual or legal obligation. If the new employer aquires staff and organized goods there is a transfer of undertaking regulated by art. 2112 of the civil code in the light of the European law.Settore IUS/07 - Diritto Del Lavoro
